We Are Invincible – Terms of Use

1) Changes to the Services and the Terms

We may modify, suspend, or discontinue the Services (in whole or in part) at any time. We may also update these Terms from time to time. Updated Terms will be posted on the Site with a revised Last Updated date. By continuing to use the Services after updates, you agree to the revised Terms.

2) Eligibility and Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

• Violate any applicable law or regulation.
• Attempt to interfere with the security, integrity, or proper functioning of the Site (e.g., hacking, introducing malware).
• Scrape, harvest, or collect information from the Site without our permission, except as permitted by law.
• Impersonate any person or entity or misrepresent your affiliation.
• Submit content you do not have the right to share or that infringes intellectual property, privacy, or publicity rights.
• Engage in harassment, hate speech, discrimination, or abusive behavior toward any individual or group.
• Use the Services in a way that interferes with or disrupts community events, livestreams, or online discussions.

3) Intellectual Property

The Services, including text, graphics, logos, designs, and other content, are owned by or licensed to us and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. Any other use requires our prior written permission. The name “We Are Invincible,” our logos, and related branding elements may not be used without our prior written permission.

4) Story Idea Submissions (Editorial Consideration Only)

If you submit a story idea, pitch, or media through the Site, you understand that submissions are provided for editorial consideration only and do not obligate us to publish, produce, or otherwise use your submission. We may review, store, and internally share submissions for evaluation and program operations. If we are interested in moving forward (including any public use), we will contact you to discuss next steps and obtain any necessary permissions/releases.

Do not submit confidential information you are not comfortable sharing for evaluation. You represent that you have the right to submit the materials and that your submission does not violate any third-party rights.

By submitting materials, you grant We Are Invincible a non-exclusive, royalty-free, worldwide license to store, review, and internally use your submission for editorial evaluation, program development, and organizational operations. We will obtain additional permissions or releases before any public use of your submission.

5) Event Participation & Media Release

We may host or participate in live and virtual events, panels, workshops, festivals, and recordings. By attending, registering for, or participating in events, you understand and agree that you may be photographed, filmed, or recorded.

By participating, you grant We Are Invincible permission to use your name, image, likeness, voice, and participation for nonprofit, educational, promotional, and archival purposes, unless you request otherwise in writing.

6) Donations

Donations made through the Services may be processed through Donorbox and/or our Fiscal Sponsor (CIF). Donation processing is subject to the terms and policies of those third parties. To the fullest extent permitted by law, donations are non-refundable. If you believe a donation was made in error, contact us promptly and we will review the request.

6) Ticketing and Registrations (Future Features)

We may offer ticketing, volunteer registrations, program applications, and event registrations. Additional terms (including refund policies, transfer policies, and event rules) may apply and will be provided at the point of purchase/registration.

7) Third-Party Links and Services

The Site may include links to third-party websites or services (including donation platforms). We do not control and are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk.

8) Disclaimers

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Content provided through the Services is for informational and educational purposes only and does not constitute medical, legal, financial, or professional advice.

9) Limitation of Liability

To the fullest extent permitted by law, We Are Invincible and our directors, officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed one hundred U.S. dollars (US $100) or the amount you paid us, if any, in the twelve (12) months preceding the claim, whichever is greater.

10) Indemnification

You agree to defend, indemnify, and hold harmless We Are Invincible and our directors, officers, employees, contractors, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Services.

11) Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if necessary to protect the Services, users, or the public.

12) Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
